Further to our announcement dated 26 October 2009 in respect of the Writ of Summons served on wholly-owned subsidiary Naim Cendera Sdn. Bhd. ("NCSB"), we append hereunder additional information as follows:-

1. The Writ of Summons was dated 12 October 2009 and served on us on 26 October 2009.

2. The area for which NCSB has been awarded a contract to design and construct the proposed Bengoh Dam is an area which the Plaintiffs are claiming Native Customary Rights.

3. NCSB is a wholly owned subsidiary of Naim Holdings Berhad.

4. The total cost of investment in NCSB is RM279.96 million.

5. Subject to the advice of our auditors and solicitors, at present it would appear that there will be no financial and/or operational impact on the Group.

6. We do not expect any major losses to be incurred arising from the Summons.

7. The Plaintiffs comprise the following:-

i) Simo Anak Sekam
ii) Tasek Anak Ayau
iii) Eddie Anak Aheng
iv) Bodui Anak Dayu
v) Bungai Anak Bengem
vi) Sirus Anak Jon

on behalf of themselves and 25 other families

8. The date of hearing has yet to be fixed by the Court.

The date of the Writ of Summons ("Summons");
Details of circumstances leading to the filing of the Summons against Naim
Cendera Sdn. Bhd. ("NCSB");
Confirmation as to whether NCSB is a major subsidiary;
The total cost of investment in NCSB;
The financial and operational impact of the Summons on the group;
The expected losses, if any arising from the Summons;
Details of the Plaintiffs; and
The date of hearing.
